GENERAL TERMS AND CONDITIONS OF SALE
These general terms and conditions of sale govern the sale of products (paintings, sculptures, drawings, photographs) on the website artinvestissement.com, as well as sales made by the company Art Investissement.
Prices on this website are listed in euros, inclusive of all taxes, but excluding shipping costs (see "Shipping" section). Ordered artworks are invoiced at the price in effect at the time the order is placed.
For orders outside mainland France: you are the importer of the artwork in question.
For artworks shipped outside the European Union, taxes may apply. These duties and amounts are not the responsibility of Art Investissement. They are your responsibility, both in terms of declarations and payments to the relevant authorities and organizations in your country.
The artworks remain the sole property of the Artist or Art Investissement until full payment of the stated price has been received.
1- Conclusion of the Sales Contract
a- The artworks are presented on the Website with a description allowing the Buyer to understand their essential characteristics and price.
b- The Buyer selects the artwork(s) they wish to purchase.
c- They confirm their choice of product(s), acknowledge and accept these Terms and Conditions by clicking to validate. They choose their payment method: either by credit card or by bank transfer to Art Investissement's account. If they choose credit card payment, they proceed with the payment immediately. If the Buyer chooses to pay by bank transfer, they will be contacted by Art Investissement within 5 business days, who will provide them with the bank account details for the transfer. d- The Buyer receives an email confirming receipt of their order. However, the sales contract between the Buyer and the Seller is subject to the condition precedent that the Product is available or that the offer is accepted, and that the transfer has been received if the Buyer has chosen this payment method.
e- The Artist is informed by Art Investissement that one or more of the Works they have listed online has been ordered.
f- The Artist agrees to confirm and/or deny the availability or price of the Product(s) ordered by the Buyer within 5 business days of receiving the information as described in point 5). In the event that the same Product is ordered by several Buyers simultaneously, and depending on the availability of that Product (unique artwork), it will only be sold to the first Buyer who places their order. The order will then be canceled for the other Buyers.
g- Once the availability of the Product(s) has been confirmed or denied and/or the price offer accepted or rejected by the Seller, Art Investissement will send an email to the Buyer informing them of the availability and the acceptance or rejection of the price offer for the ordered Product(s).
2- Payment Security
Art Investissement has chosen high-performance and rigorous tools to ensure the security of payment methods. Art Investissement has adopted the PayPal System payment solution, a leader in online payments, using SSL (Secure Socket Layer) encryption and 3D Secure, currently the most effective security systems, which establish a secure encrypted connection directly between the Buyer and the bank.
Art Investissement has no access whatsoever to the confidential information relating to the payment method used by the Customer. Therefore, the Customer's bank details will be requested for each new order. Indeed, only PayBox has access to this confidential information, which remains inaccessible to third parties.
Although Art Investissement uses encrypted security software, the security of information and payments transmitted via the Internet or email cannot be guaranteed. Art Investissement cannot be held liable for damages resulting from the use of electronic means of communication, including (but not limited to) damages resulting from a failure or delay in the transmission of communication.
